Welcome to Twist Drops! Please read these Terms and Conditions ("Terms") carefully before using our platform. Accessing, registering, and using the site implies explicit and unconditional acceptance of these terms.

1. About Us (Platform Operator)

Service Definition: Twist Drops is a "Marketplace" platform that facilitates the connection between Buyers (Users) and local Sellers (referred to as "Artisans"). VLAH SOFTWARE HOUSE SRL acts exclusively as a technical intermediary and is not party to the sale-purchase contract of food products.

2. User Account

2.1. Types of Accounts

Client Account: Accessible via "Magic Link" (passwordless authentication). Intended for individuals who wish to reserve products.
Artisan Account (Partner): Accessible via email and password. Intended for legal entities or authorized individuals who produce and sell products.

2.2. Security

You are responsible for maintaining the confidentiality of access data. Any activity conducted on your account belongs entirely to you.

3. For CLIENTS: How Reservations Work

3.1. The "Drop" Model and Reservation

Products on Twist Drops are available for limited periods ("Drops").

Placing an order on the site represents a Reservation (Request for Quote) and not an immediately confirmed purchase.
After placing the reservation, the order receives "Pending" status.

3.2. Validation and Contract

The sales contract is considered concluded only when the Artisan changes the order status to "Confirmed".

The Artisan has the right to refuse a reservation due to insufficient stock or production impossibility.
In case of refusal, you will not be charged (if payment was made online) or have no payment obligation (if payment is on pickup).

3.3. Location and Pickup

Private Locations: For some Artisans (e.g., Home Bakers), the exact pickup address is confidential and will be disclosed via email only after order confirmation.
Failure to Pickup: Since products are perishable and made to order, unjustified failure to pick up a confirmed order may lead to platform access suspension.

3.4. Return Policy (Exceptions)

According to OUG 34/2014 (Romania) and EU Directives, food and perishable products are excepted from the right of withdrawal (return). Once the order is confirmed and the product prepared, it can no longer be canceled except with the Artisan's explicit agreement.

4. For ARTISANS (Partners)

4.1. Responsibility for Products

As an Artisan, you are solely responsible for:

Quality, freshness, and food safety of products.
Holding all necessary sanitary-veterinary authorizations for operation.
Correct display of ingredients and allergens in the product description ("Full Description" field).

VLAH SOFTWARE HOUSE SRL does not physically verify products and assumes no responsibility for any foodborne illnesses or problems caused by sold products.

4.2. Order Fulfillment

You are obligated to manage orders from "Studio" in a timely manner:

Confirm (or refuse) received reservations.
Ensure availability of confirmed products on the "Drop" date and time.

4.3. Customer Data Processing (DPA)

Twist Drops transfers customer data (Name, Phone, Email) strictly for order processing and delivery-related communication.

Prohibited: Using this data for marketing (newsletters, spam) without separate customer consent.

Prohibited: Selling or alienating this data.

You act as an independent Data Controller and are directly liable under law for how you store this data.

5. Intellectual Property

Platform Content: Logo, source code, Twist Drops design are property of VLAH SOFTWARE HOUSE SRL.
Artisan Content: Photos and product descriptions uploaded by Artisans remain their property. By uploading, you grant the platform a non-exclusive license to use images for site promotion.

6. Limitation of Liability

The platform is provided "as is". We do not guarantee that:

The service will be uninterrupted or error-free (although we use modern technologies like Vercel and Supabase for stability).
Artisan products will meet your culinary expectations.

Under no circumstances will VLAH SOFTWARE HOUSE SRL be liable for indirect damages, loss of profit, or health problems resulting from product consumption.

7. Changes to Terms

We reserve the right to modify these terms. Any changes will be notified on the site. Continued use of the platform after changes constitutes acceptance of them.

8. Applicable Law and Disputes

These Terms are governed by Romanian law. Any dispute that cannot be resolved amicably will be subject to the competent courts at the registered office of VLAH SOFTWARE HOUSE SRL (Sibiu).
